Abstract |
Section 23 of the Canadian Charter of Rights and Freedoms gives qualified parents the constitutional right to have their children educated at the elementary and secondary levels in the language of the official language minority of the province they live in. The author points out that in 2005 the Supreme Court of Canada ruled against three appeals concerning access to English schools in Quebec. Focusing primarily on two of these appeal cases -- Gosselin vs Québec and Solski vs Québec --, the author notes that the Court had to ascertain in the first appeal whether reserving access to an English school only to those entitled under Quebec's Charter of the French Language (Bill 101) did not constitute unlawful discrimination against the parents of the French-speaking majority and, therefore, contravened their equality rights; and in the second case whether a child to qualify in Quebec for access to English-language schooling needed a parent to have received most of his/her elementary or secondary education in English in Canada. The author analyzes and comments on these decisions and assesses their impact at the Quebec and Canadian levels.
