Abstract |
Montreal poet, lawyer and McGill University law professor F.R. Scott (1899-1985) represented Montreal restaurateur Frank Roncorelli in his ten year-long legal battle against Quebec Premier Maurice Duplessis for revoking his liquor licence. Duplessis had Roncorelli's liquor licence revoked because the restaurateur had posted property bonds to free Jehovah Witnesses who had been arrested in Montreal for distributing religious tracts on the streets of the city. In a 1959 landmark constitutional decision of the Supreme Court of Canada, it was ruled that the premier had overstepped his authority by revoking the licence, and that no public official, even the premier of a province, was above the law.
