Abstract |
The authors assess whether the intentions of the French government and of Quebec's Assemblée nationale, who were the sources of two language laws, have been respected by the judicial interpretation of these laws. In order to achieve this, they define French republicanism by stressing the importance of citizen participation in the development of the law, state, people, nation, majority language, linguistic diversity at the global scale, historic majority, and national identity. They then define "Anglo-Saxon" liberalism by emphasizing the importance of individual and minority rights, individuals, linguistic diversity at the national level, minorities, and minority identities. Then, using these elements of these two political theories, the authors analyze extracts from parliamentary archives and elements of text or context related to the laws. Similarly, decisions of the Conseil constitutionnel, the Cour de Cassation and the Conseil d’État of France, and of the Court of Appeal and the Superior Court of Québec are analyzed using these elements.
